Model Town case: Supreme Court orders Lahore High Court decision in 3 months

The Supreme Court ordered the Lahore High Court to decide the Model Town case in 3 months.

A three-member bench, headed by Chief Justice of Pakistan Justice Gulzar Ahmed, heard the various petitions of the victims of Model Town tragedy.

Justice Ejaz ul Ahsan, who was present in the judicial bench, while hearing the petition for the restoration of the new JIT formed in the Model Town tragedy, remarked that the petitioner had been requested for the new JIT. Notice was also given which did not appear at that time.

In his remarks, Justice Ijaz-ul-Hassan further said that the Punjab government had agreed on the creation of a new JIT, after which the Punjab government had constituted the JIT.

Justice Ejaz-ul-Hassan remarked that the petitioner went to the High Court to make the Supreme Court order ineffective, but how can the High Court make the Supreme Court order ineffective?

On this the petitioner's lawyer said that the Supreme Court did not order any new JIT. The JIT formed by the Punjab Government has been challenged in the High Court.

Later, the Supreme Court rejected the Lahore High Court's interim decision regarding the Model Town tragedy and retained the interim order of the High Court to stop the new JIT.

The Supreme Court, while disposing of the victims' appeals regarding the Model Town decision, ordered the Lahore High Court to hear the case in three months.

The court remarked that many lives were lost in Model Town tragedy, people were injured and a decision should be taken as soon as possible.

At the same time, the court ordered that the Registrar of Lahore High Court, the Supreme Court order be placed before the Chief Justice of the High Court to form a new bench for the trial.

The Chief Justice remarked that the High Court should take its decision soon so that the Model Town tragedy will come to a logical end.

It may be recalled that the Full Bench of the Lahore High Court in March last year barred the team from working on the petition against the new Joint Investigation Team (JIT) formed to investigate the Model Town tragedy.

It may be recalled that on December 5, 2018, the Punjab government decided to construct a new JIT for a retrospective investigation in the Model Town case, after which the petition was disposed of in the Supreme Court.

The Punjab government had set up a new JIT under the Model Town case, headed by IG Motorway AD Khawaja.

Other members of the committee include ISI correspondent Lt. Col. Mohammad Atiq Zaman, Lt. Col. Irfan Mirza, Military Intelligence (MI), Deputy Director General (DG) Intelligence Bureau (IB) Mohammad Ahmed Kamal and DIG. Headquarters police include Gilgit-Baltistan Qamar Raza.

The Joint Investigation Team had decided to investigate Nawaz Sharif at the time of Model Town tragedy and after the accountability court's permission, he was interrogated in Lahore's Kot Lakhpat Jail for two hours while also describing former Punjab Chief Minister Shahbaz Sharif. Was recorded.

Model Town Tragedy

It is to be remembered that on June 17, 2014, in the Model Town area of ​​Lahore, the operation was carried out to eliminate the encroachments in front of the residence of Dr Tahir-ul-Qadri, the central secretary of the Tehreek-e-Minhaj-ul-Quran International and the head of the Pakistan Awami Tehreek (PAT).

During the operation, PAT workers resisted and clashed with police, resulting in the death of 14 people and wounding close to 90.

Applicant Bisma Amjad filed a petition in the Human Rights Cell of the Supreme Court against the murder of her mother and requested the creation of a new JIT to investigate the incident.

Chief Justice Mian Saqib Nisar, Justice Asif Saeed Khosa, Justice Sheikh Azmat Saeed, Justice Faisal Arab and Justice Mazhar Alam Khan Mian Khel were present in the five-member large bench for investigation of Model Town tragedy.

It is also to be remembered that the Commission set up to investigate the Model Town tragedy in 2014 had completed the inquiry report and handed it over to the Punjab Government, which was not made public.

However, the court later ordered that the Model Town report be made public, after which the government had brought Justice Baqir Najafi's report.
